The article puts forward an interchange between Jacques Derrida and Bernard Lonergan, suggesting both thinkers delineate notions of human development that include stabilizing and innovating moments. While the perspective adopted in the article remains more closely aligned with Lonergan’s foundational, methodological approach than with Derrida’s deconstructive process, the article acknowledges that Derrida’s thought is more resonant with the contemporary intellectual context. Derrida challenges the possibility of an authentic foundational philosophy even as he accepts the utility of coherent but transitional framings (...) for human interpretation.Lonergan’s critical cognitional theory, epistemology, and metaphysics complement and correct Derrida’s conflation of the human project with the interplay between the constructive and transgressive moments of interpretation. Still, Derrida’s understanding of discourse replaces classicism as the shadow that constrains and enables contemporary inquirers as they assume greater responsibility for their participation in social development. The article develops an Ignatian perspective, from within which it then interprets and amplifies Bernard Lonergan's intellectual project. Exploiting recent analyses of medieval memorial culture and the rhetorical dynamicsof monastic spiritual practice, the article highlights the performative quality of key Ignatian texts, paying particular attention to the categories of ornamentation and ordering . Appreciating the vantage afforded by heightened self-presence, reflexive knowledge and intentional praxis, the article then explores Lonergan's project, employing the rubric of ornamentation and ordering to investigate the (...) interaction between cognitional activity and the matrix of desire informed by unbounded wonder, specific desires and distorting bias. Formative self-appropriation is then considered as a religious process, in which the self gathers the resources of Scripture and tradition to compose a creative faith response to the divine initiative of transforming love, a response that unfolds more fully in the co-development of personal, social and cultural activity. Flannery O'Connor is considered one of America's greatest fiction writers. The immensely talented Robert Giroux, editor-in-chief of Harcourt, Brace & Company and later of Farrar, Straus & Giroux, was her devoted friend and admirer. Impressively researched and rich in biographical details, this book chronicles Giroux?s and O?Connor?s personal and professional relationship, not omitting their circle of friends and fellow writers, including Robert Lowell, Caroline Gordon, Sally and Robert Fitzgerald, Allen Tate, Thomas Merton, and Robert Penn Warren. As Patrick Samway explains, Giroux guided O'Connor to become an internationally acclaimed writer of fiction and nonfiction, especially during the years when she suffered from lupus at her home in Milledgeville, Georgia, a disease that eventually proved fatal. Excerpts from their correspondence, some of which are published here for the first time, reveal how much of Giroux's work as editor was accomplished through his letters to Milledgeville. They are gracious, discerning, and appreciative, just when they needed to be. This article explores some implications of using a critical realist theoretical framework for the study of education, in particular the core activities of learning and teaching. Many approaches have been made to understanding learning and teaching, but they tend to fall into one of two camps. The first includes approaches known as objectivism, instructivism and behaviourism, and is interpreted here as embodying principles of empiricism. The second comprises various takes on constructivism, particularly social constructivism, and is interpreted here as embodying (...) idealism. This paper does not wholly endorse or reject either objectivism or constructivism, but draws elements from each. The key difference for educators is that the starting position is not the transmission of knowledge, as in objectivism, or the construction of knowledge by learners, as in social constructivism. Instead it foregrounds the learning environment, arising from the realist premise that the possibilities for knowledge are given in the ontology. For educators this means the learning environment is not simply the location of learning, as widely construed, but the set of conditions that enable and constrain learning. (shrink)

Following Foucault’s remarks on the importance of architecture to disciplinary power, this paper offers a typology of power relations expressed in different models of Internet governance. Infrastructure governance understands the Internet as a common pool or public resource, on the model of traditional infrastructures like roads and bridges. Modulation governance, which I study by way of Net Neutrality debates in the U.S., understands Internet governance as traffic shaping. Portal governance, which I study by way of data collection policies of dominant (...) platform companies, understands the Internet as creating a user experience that facilitates data mining. The latter two are forms of architectural disciplinary power that undermine the first. I then argue that the rise of portal and modulation governance primarily serves to remake parts of civil society by fostering market norms of consumption and entrepreneurialism. In that sense, efforts to shape Internet architecture need to be understood as techniques of subjectification. (shrink)

So the substantial form of an oak tree could not be something as simple or crude as its shape. Nevertheless, the example of the bronze statue does (...) have the virtue of illustrating one of the chief advantages of hylomorphism as a philosophy of the human person. Although we can talk about the bronze and the shape of the statue, respectively, it still seems correct to say that the statue is exactly one thing, not two things. Likewise, although we can talk about the matter and the form of a human being, the hylomorphist insists that a human being is exactly one thing, not two things accidentally conjoined. (shrink)

This paper situates the data privacy debate in the context of what I call the death of the data subject. My central claim is that concept of a rights-bearing data subject is being pulled in two contradictory directions at once, and that simultaneous attention to these is necessary to understand and resist the extractive practices of the data industry. Specifically, it is necessary to treat the problems facing the data subject structurally, rather than by narrowly attempting to vindicate its rights. (...) On the one hand, the data industry argues that subjects of biometric identification lack legal standing to pursue claims in court, and Facebook recently denied that that its facial recognition software recognizes faces. On the other hand, industry takes consent to terms of service and arbitration clauses to create enforceable legal subject positions, while using promises of personalization to create a phenomenological subject that is unaware of the extent to which it is being manipulated. Data subjects thus have no legal existence when it is a matter of corporate liability, but legal accountability when it is a matter of their own liability. Successful reform should address the power asymmetries between individuals and data companies that enable this structural disempowerment. (shrink)

As a central part of the regulation of contemporary economies, intellectual property (IP) is central to all aspects of our lives. It matters for the works we create, the brands we identify and the medicines we consume. But if IP is power, what kind of power is it, and what does it do? Building on the work of Michel Foucault, Gordon Hull examines different ways of understanding power in copyright, trademark and patent policy: as law, as promotion of public (...) welfare, and as promotion of neoliberal privatization. He argues that intellectual property policy is moving toward neoliberalism, even as that move is broadly contested in everything from resistance movements to Supreme Court decisions. Like Lewis, many philosophers hold reductionist accounts of chance (on which claims about chance are to be understood as claims that certain patterns of events are instantiated) and maintain that rationality requires that credence should defer to chance (in the sense that under certain circumstances one's credence in an event must coincide with the chance of that event). It is a shortcoming of an account of chance if it implies that this norm of rationality is unsatisfiable by computable agents. This (...) shortcoming is more common than one might have hoped. These notes discuss some aspects of the sort of symmetry considerations that arise in philosophy of physics. They describe and provide illustration of: (i) one common sort of symmetry argument; and (ii) a construction that allows one to eliminate symmetries from a given structure.

Two symmetry arguments are discussed, each purporting to show that there is no more room for a preferred division of spacetime into instants of time in general relativistic cosmology than in Minkowski spacetime. The first argument is due to Gödel, and concerns the symmetries of his famous rotating cosmologies. The second turns upon the symmetries of a certain space of relativistic possibilities. Both arguments are found wanting.

There is a widespread impression that General Relativity, unlike Quantum Mechanics, is in no need of an interpretation. I present two reasons for thinking that this is a mistake. The first is the familiar hole argument. I argue that certain skeptical responses to this argument are too hasty in dismissing it as being irrelevant to the interpretative enterprise. My second reason is that interpretative questions about General Relativity are central to the search for a quantum theory of gravity. I illustrate (...) this claim by examining the interpretative consequences of a particular technical move in canonical quantum gravity. (shrink)

SummaryPutnam claims that the objects we experience are “mind‐dependent” and “theory‐dependent”. He also writes that they are “constructed within our theories”. It is difficult to say what he means by these claims. I conclude that, according to Putnam, “empirical objects” do not really exist. But I attempt to show the sense in which he can be considered a realist about these objects. Putnam has adopted an idealism which allows for the correctness of realist claims within appropriate contexts. I also discuss (...) Putnam's solution to the problem of how we manage to refer to “empirical objects”. I argue that this solution, and his views concerning the nature of objects, are faced with important difficulties. Scott Gordon provides a magisterial review of the historical development of the social sciences from their beginnings in renaissance Italy to the present day.

Economic sanctions are emerging as one of the major tools of international governance in the post-Cold War era. Gordon considers the issue of sanctions within three ethical frameworks: just war doctrine, deontological ethics, and utilitarianism.

This paper uses Heidegger’s discussion of artifacts in Being and Time to motivate a phenomenological critique of Digital Rights Management regimes such as the one that allows DVDs to require one to watch commercials and copyright notices. In the first section, I briefly sketch traditional ethical approaches to intellectual property and indicate the gap that a phenomenological approach can fill. In section 2, following Heidegger’s discussion in Being and Time, I analyze DRM technologies as exemplary of the breakdown of things (...) as ready-to-hand; in particular, DRM is an example of what Heidegger calls "obstinacy." In section 3, I argue that this sort of concern generalizes beyond digital rights management due to its imbrication in ordinary, everyday experience. Finally, in section 4, I propose a framework for analyzing DRM in terms of our individuation from "the They," emphasizing how DRM undermines the functioning of "responsibility.". (shrink)

Quantum degrees of freedom greatly enrich nonlinear systems, which can support nonlocal control and superposition of states. Basing my discussion on Yasue’s quantum brain dynamics, I suggest that the Cartesian subject is a cybernetic process rather than a substance: I am nonlocal control and my meanings are cybernetic variables. Meanings as nonlocal attunements are not mechanically determined, thus is it concluded we have freedom to mean.
